Article 1, Section 3, Paragraph 6
The Senate shall have the sole Power to try all Impeachments. When sitting for that Purpose, they shall be on Oath or Affirmation. When the President of the United States is tried, the Chief Justice shall preside: And no Person shall be convicted without the Concurrence of two thirds of the Members present.
Conviction by 2/3rds
Conviction must be imposed by the law for ungodly action.
A close vote is a bad situation. It means there is a great deal of confusion about something. Because a person’s career is at stake, there needs to be a more decisive vote.
The term used is “concurrence.” This simple means that at least 2/3rds must be in agreement with the charges and that there are direct lines of evidence that point to the accused person’s guilt.
There are four ways in Scripture for one to receive a conviction of sin. Biblically, a person should judge themselves so they are not judged. Thus, the first means of conviction is one’s own conscience
John 8:9, "And they which heard it, being convicted by their own conscience, went out one by one, beginning at the eldest, even unto the last: and Jesus was left alone, and the woman standing in the midst."
Romans 2:15, "Which shew the work of the law written in their hearts, their conscience also bearing witness, and their thoughts the mean while accusing or else excusing one another;)"
Secondly, the gospel brings conviction.
Acts 2:37, "Now when they heard this, they were pricked in their heart, and said unto Peter and to the rest of the apostles, Men and brethren, what shall we do?"
Next, the Holy Spirit convicts.
John 16:7-11, "Nevertheless I tell you the truth; It is expedient for you that I go away: for if I go not away, the Comforter will not come unto you; but if I depart, I will send him unto you. And when he is come, he will reprove the world of sin, and of righteousness, and of judgment: Of sin, because they believe not on me; Of righteousness, because I go to my Father, and ye see me no more; Of judgment, because the prince of this world is judged."
These are the steps of conviction for a child of God.
The fourth area deals with the ungodly. For them, we must have the law to convict them.
James 2:9, "But if ye have respect to persons, ye commit sin, and are convinced of the law as transgressors."
1 Timothy 1:9-10, "Knowing this, that the law is not made for a righteous man, but for the lawless and disobedient, for the ungodly and for sinners, for unholy and profane, for murderers of fathers and murderers of mothers, for manslayers, For whoremongers, for them that defile themselves with mankind, for menstealers, for liars, for perjured persons, and if there be any other thing that is contrary to sound doctrine;"
Thus the law must convict of all ungodly deeds.
